The Review and Investigation Stage

  • Upon filing a complaint at the Registry, a file is opened and assigned to a state counsel.
  • The complaint and supporting documents are reviewed to determine the merits of the complaint as per the Commission’s mandate.
  • If the particulars of the complaint do not constitute acts of professional misconduct, the complaint is rejected, the file closed and the complainant informed. 
  • Where the particulars of the complaint constitute acts of professional misconduct and sufficient evidence is produced, the Commission writes to the advocate seeking an explanation of the facts surrounding the complaint. 
  • On completion of the investigations, a determination is made as to whether act(s) of professional misconduct have been established or not. 
  • If the act(s) of professional misconduct is supported by the evidence, the complaint is either forwarded to the Commission’s IHADR Division or the Prosecution Division.
