Establishment

The Advocates Complaints Commission (ACC) is a statutory body established in 1989 under section 53 of the Advocates Act (Cap. 16, Laws of Kenya) to enquire into complaints of professional misconduct against any advocate, firm of advocates, or any member or employee thereof. The ACC investigates and prosecutes complaints at the Disciplinary Committee/Tribunal. In addition, the ACC promotes reconciliation, encourages and facilitates amicable settlement of complaints of professional misconduct between Advocates and Complainants through its In-House Alternative Dispute Resolution (IHADR) mechanism.

Administratively, the ACC is a department within the Office of the Attorney General and Department of Justice.

The Advocates Complaints Commission (ACC) is a statutory body established under Section 53(1) of the Advocates Act (Cap 16, Laws of Kenya). Administratively, it operates as a department within the Office of the Attorney General and Department of Justice.

The ACC is an important institution in both achieving a unified justice system and enhancing access to justice for all. Its object and purpose is to protect the public from professional misconduct by advocates, preserve and enhance the integrity and standards of the legal profession.

What We Do:

The Commission serves the public by:

  • Receiving, reviewing and investigating complaints of professional misconduct made against an advocate, firm of advocates, or a member or employee of the firm from members of the public;
  • Charge and prosecute advocates at the Disciplinary Committee/Tribunal for professional misconduct;
  • Promoting reconciliation by encouraging and facilitating timely amicable settlement of complaints through its            In-House Alternative Dispute Resolution Mechanism. 
  • Educating members of the public on their rights and obligations in the advocate-client relationship;
  • Provide information about the professional integrity of advocates for appointment to public offices.
  • Issuance of a Certificate of Good Standing to advocates.
How We Support The Bar And Law Schools
  • To support the Bar and law schools, the Commission:
  • Participates in Continuing Legal Education programs on ethics and practice management;
  • Provides articles on ethics issues on its website and relevant journals;
  • Works with the Law Society of Kenya and the Judiciary to amend, develop and review rules of professional conduct and discipline of advocates;
  • Collaborate with law schools to deliver lectures on professional ethics.
