Prosecution Stage

  • A complaint file is from Review & Investigation Division or Alternative Dispute Resolution Division for drafting charges of Professional Misconduct.
  • Counsel then drafts an Affidavit of Charge highlighting specific Professional Misconduct offences committed by the advocate.
  • The Affidavit of Charge is thereafter filed at the Advocates Disciplinary Committee /Tribunal.
  • The charge is then assigned a Disciplinary Cause/Case Number and listed for plea taking by the Advocates Disciplinary Committee/Tribunal after a successful prima facie case has been established.
  • After plea taking, the case proceeds to hearing with the Commission appearing on behalf of the complainants.
  • The Advocates Disciplinary Committee/Tribunal thereafter delivers its Judgment and or findings on the Professional Misconduct.
  • The Commission follows up on compliance with the Sentence/orders of the Advocates Disciplinary Committee/Tribunal.
