Alternative Dispute Resolution Stage

  • A Complaint is received in the IHADR Division from the Review and Investigation Division or Prosecution Division recommending the IHADR Process.
  • Possible issues for Determination during the Commission`s IHADR session are identified.
  • Parties are invited for the Commission`s IHADR session based on the availability of a date in the Division`s Diary.
  • During the IHADR session, a settlement agreement is entered into between the parties and executed.
  • Where parties comply with the terms of the Agreement entered into, the Complaint is marked as amicably settled and closed.
  • Where the Advocate defaults on the terms of the Agreement entered into, the complaint is referred to the Prosecution Division.
